Terms and conditions

§ 1 Scope

These general terms and conditions apply to all contracts for the “Felix” service between IGS Social Tech UG (haftungsbeschränkt) i. G., Kruppstraße 108, 40227 Düsseldorf (“we”) and our customers (“you”).

§ 2 Service

Felix is a telephone companion service. An artificial intelligence calls the named person at the agreed frequency and time window, has a short conversation and collects feedback about their care. With the consent of the person being called, we pass this feedback on to their home-care service.

Felix is not an emergency service, not a home emergency alarm system and does not provide medical or nursing advice. Felix does not make diagnoses or give treatment recommendations. In an emergency, always call 112.

We aim for high availability. Individual calls may be moved or may not take place for technical reasons.

§ 3 Conclusion of the contract

By submitting the booking form, you make an offer to enter into a contract. The contract is concluded when we confirm the booking by email or by phone, or when Felix calls for the first time.

§ 4 Free month and price

The first month from the first call is free of charge. After that, the price is €10 per month including statutory VAT. The price includes all calls at the agreed frequency. The person being called has no phone costs.

You will be informed of the payment method before the free month ends. [Add payment method and due date.]

§ 5 Term and cancellation

The contract runs for an indefinite period. You can cancel it at any time with effect from the end of the current month – by email, by phone, in writing or through our website. If you cancel during the free month, you will not be charged anything.

Our right to terminate for good cause without notice remains unaffected.

§ 6 Your obligations

You make sure that the phone number given is correct. If you book for another person, you confirm that this person agrees to the calls. Please let us know promptly about any changes.

§ 7 Liability

We are liable without limitation for intent and gross negligence and for injury to life, body or health. In cases of slight negligence, we are only liable for breach of essential contractual obligations, and only up to the foreseeable damage typical for this type of contract. Liability under the German Product Liability Act (Produkthaftungsgesetz) remains unaffected.

§ 8 Data protection

§ 9 Right of withdrawal

As a consumer, you have a statutory right of withdrawal. You can find the details in our information on the right of withdrawal.

§ 10 Final provisions

The law of the Federal Republic of Germany applies. Mandatory consumer protection provisions of the country in which you have your habitual residence remain unaffected. If any provision is invalid, the remaining provisions remain valid.
